Military Court Declares Army Major 'Unworthy' and Strips Rank for Girlfriend's Murder

Brazil's Superior Military Court (STM) has unanimously ruled to strip a Brazilian Army major, Nildo Gonçalves de Souza, of his rank and status. The decision declares him unfit for military service following his definitive conviction for the murder and concealment of his girlfriend's body.

Gonçalves de Souza was sentenced to 13 years in prison by a common court for the crime, which involved a tumultuous extramarital relationship. The STM's ruling, based on constitutional and military statutes, means he will lose his position and rank within the Army.

The court officially communicated its decision to the Commander of the Army, General Tomás Miguel Miné Ribeiro Paiva, on Wednesday. The ruling followed a hearing by the Tribunal de Honra (Honor Tribunal) and will be formally sent to the Army Command for administrative action after the judgment becomes final.

The case originated from a representation filed by the Military Justice Prosecutor's Office. The STM not only rejected the defense's arguments but also requested the Superior Electoral Court to recognize Gonçalves de Souza's ineligibility, in accordance with Brazil's "Ficha Limpa" (Clean Slate) law.

According to the legal proceedings, the murder occurred on January 19, 2012, in São Gabriel da Cachoeira, Amazonas state. The victim had reportedly purchased gifts for the major's birthday and mentioned reconciling their relationship, while also noting his alternating moments of affection and violence. The prosecution argued the murder was premeditated, describing it as an ambush during a supposed celebration.
