New York merchants sue Mayor Mamdani to halt municipal supermarkets

A coalition of New York City merchants is taking legal action against Mayor Zohran Mamdani, seeking to stop his controversial municipal supermarket plan. The Multicultural Business Coalition (MBC), representing 50 ethnic chambers of commerce, filed a lawsuit in the State Supreme Court in Manhattan, arguing the initiative as proposed would cause "irreparable harm" to their businesses.

The merchants contend that the municipal supermarkets violate New York's Civil Rights Law and the state Constitution by denying equal protection. They argue that the city-funded stores, which plan to offer up to a 30% discount on basic necessities, create unfair competition. Small businesses, many owned by immigrants and minorities, cannot match these subsidized prices and fear being driven out of business.

This legal challenge comes after months of opposition from small business owners who believe their tax money is being used to compete against them. Mayor Mamdani, a democratic socialist, announced the plan to establish five municipal supermarkets by 2029, aiming to combat rising food prices. However, the MBC asserts that the initiative lacks a prior impact study and contradicts the city's past decisions, such as denying Walmart entry to protect local businesses.

Frank Garcia, president of the MBC board, highlighted the negative impact of large retailers like Costco on small businesses in areas like El Barrio. He expressed concern that the new municipal stores would disproportionately affect Arab and Mexican-owned businesses, echoing the city's previous stance against big-box stores that could harm smaller, local establishments.
