Newsom Signs AB 2559: When California Construction Permit Deposits Will Be Returned

California Governor Gavin Newsom has signed into law Assembly Bill 2559, which mandates that cities and counties refund specific deposits associated with construction or demolition permits. This new legislation, set to take effect on January 1, 2027, aims to ensure that individuals and entities who paid refundable deposits are reimbursed once they demonstrate compliance with the permit's conditions.

The law targets deposits paid for construction, demolition, or building permits. It allows the person or entity that paid the deposit to recover the full amount if, within three years following the final inspection, they provide documentation proving they have met all specified conditions, particularly those related to waste diversion. Local authorities can deny the refund only if the submitted documents show non-compliance with applicable requirements.

The California Legislature introduced AB 2559 to address situations where local governments were retaining refundable deposits even after property owners or contractors had fulfilled all obligations. This practice was creating unnecessary financial strain. The new law seeks to guarantee the timely return of these funds once compliance is verified, providing greater predictability for property owners, contractors, and businesses by preventing economic resources from remaining tied up after project completion and verification.
