Peru fines tourism agencies S/4.9 million after fatal Huacachina dune accident

Peru's consumer protection agency, Indecopi, has imposed a significant fine of S/4.9 million (approximately $1.3 million USD) on two tourism agencies following a fatal accident in the popular Huacachina dunes. The incident, which occurred in May 2025, led to the death of a foreign tourist during a tubular vehicle ride.

Indecopi fined Aventura Sin Fronteras E.I.R.L. and Lima Experience S.A.C. a total of 900 UIT (tax units), the maximum penalty for consumer protection violations. The fine was issued in the first instance by the Indecopi Regional Office Commission in Ica. The companies have the right to appeal the resolution to the Specialized Consumer Protection Chamber, the final administrative instance.

Investigations revealed that Aventura Sin Fronteras, the operator of the tour, allowed the ride to proceed in a vehicle lacking adequate safety conditions. This resulted in the vehicle moving uncontrollably on a sandy slope, causing the accident and the tourist's death. Lima Experience S.A.C., which marketed the tour package, failed to verify that the contracted operator provided services under safe conditions. Indecopi concluded that subcontracting did not absolve Lima Experience of its responsibility to customers.

In addition to the substantial fine, both companies are prohibited from offering or operating tubular vehicle tours unless they implement adequate safety, supervision, and control measures to protect consumers. This ruling aims to prevent future incidents and ensure the safety of tourists engaging in adventure activities.
