Prosecutors Drop Case Against Former President Moon Jae-in in West Sea Incident

South Korean prosecutors have closed the case against former President Moon Jae-in, deciding not to indict him on charges related to the alleged downplaying and cover-up of the 2020 West Sea shooting incident. The decision, announced on August 26, comes after an investigation lasting roughly three years and seven months, with prosecutors citing insufficient evidence to proceed.

The case stemmed from the killing of fisheries official Lee Dae-jun by North Korean forces in September 2020. Controversy erupted over the Moon administration's response, particularly its suggestion of the official's potential defection, which critics argued downplayed the North's aggression. This led to a significant political and public debate regarding the government's handling of the incident.

Following the Yoon Suk-yeol administration's inauguration in 2022, the Board of Audit and Inspection initiated an audit of the decision-making process at the time. This audit subsequently led to requests for investigations into former National Security Office chief Seo Hoon and others. In December 2022, a civic group filed a complaint against Moon, alleging he had ultimately approved the cover-up based on reports from various government agencies.

While prosecutors indicted Seo Hoon and others, they were all acquitted in court. The decision to not indict Moon Jae-in marks the conclusion of a contentious chapter, bringing a close to the legal proceedings against the former president concerning this sensitive inter-Korean incident.
