Senate President Tavares-Finson raises concerns over allegations of CCJ panel manipulation

Senate President Tom Tavares-Finson has voiced serious concerns regarding allegations of manipulation within the Caribbean Court of Justice (CCJ), warning that such claims could jeopardize Jamaica's potential adoption of the court as its final appellate jurisdiction.

The concerns stem from recent reports originating in Trinidad, citing leaked emails that allegedly reveal internal disputes among CCJ judges and, more alarmingly, the manipulation of judicial panels to predetermine case outcomes. Tavares-Finson acknowledged that disagreements within courts are not uncommon but stressed the critical importance of how such conflicts are managed to maintain public trust. According to Tavares-Finson, the leaked documents suggest one judge claimed to have been removed from a panel hearing a case relevant to Jamaica due to his legal opinion. He indicated that the judge was allegedly replaced by the court's president. "That is an extremely worrying issue. That is an issue that has to be dealt with publicly and in such a manner that the confidence of the people of the court can be restored," Tavares-Finson urged.

He emphasized that these allegations, if proven, would imply that judicial panels are being manipulated to reach predetermined decisions, a situation he described as "very dangerous" and reflective of Caribbean skepticism towards the CCJ. Tavares-Finson called for a public hearing to address the claims, particularly given that they involve an accusation against the court's president. He also questioned the opposition's stance on making accession to the CCJ a condition for transitioning Jamaica to a republic, suggesting it would be "extremely reckless" to consider joining while these allegations remain unresolved.
