Siblings Get Prison Terms for Beating Mother to Death; Patricide Charge Rejected

The Hankyoreh reports on a deeply disturbing case where a brother and sister were sentenced for the death of their mother, with whom they lived. The Seoul Southern District Court handed down sentences of seven years for the sister and three years for the brother, finding them guilty of causing death through assault against a parent, rather than the more severe charge of patricide.

The court's decision to not recognize the patricide charge hinged on the finding that while the assault was prolonged and resulted in death, there was insufficient evidence of intent to kill. This distinction is critical, though the court did not shy away from condemning the siblings' actions. Judge Park Jong-yeol described the crime as 'unfilial' and 'morally reprehensible,' emphasizing the extreme physical and mental suffering the elderly mother endured over a significant period.

This case is one where the victim, due to old age, had declining cognitive abilities and difficulty moving, and was assaulted for a considerable period. Considering the extreme physical and mental suffering the victim must have felt, the crime is unfilial and the nature of the offense is not good.

However, the court also acknowledged mitigating circumstances. The siblings did attempt to seek medical treatment for their mother and even performed CPR in her final moments. They also called emergency services. These actions, while not negating the gravity of their assault, were considered in the sentencing, alongside the fact that the mother suffered from age-related cognitive decline and mobility issues.

This case, which saw the siblings arrested in December after their mother was found with extensive bruising, highlights the tragic complexities that can arise within families, particularly concerning the care of elderly parents. The prosecution had sought life imprisonment for the sister and 20 years for the brother, arguing they could have foreseen her death, especially after leaving her exposed to the cold without adequate clothing.
