South Korea Enacts Landmark Disability Rights Law, Hailed as 'Constitution for Persons with Disabilities'

In a historic move, the South Korean National Assembly has passed the "Act on Guarantee of Rights for Persons with Disabilities," a legislative milestone celebrated by disability rights groups across the nation. This act, hailed as the "Constitution for Persons with Disabilities," signifies a fundamental shift in how society views and supports individuals with disabilities, moving away from a paradigm of welfare and charity towards one centered on rights and autonomy.

The newly enacted law clearly defines the obligations of the state and local governments in ensuring the rights of persons with disabilities. It explicitly recognizes core rights, including the right to dignity, equality, self-determination, and meaningful participation in policy development. A significant provision within the act is the mandate for de-institutionalization, reflecting a commitment to supporting independent living within the community, in line with the UN Convention on the Rights of Persons with Disabilities.
