Taiwan Court Convicts Man of Child Molestation After Overturning Acquittal Based on Video Evidence and Family Reaction

A man accused of groping a young girl in a shopping mall has been convicted on appeal, overturning an earlier acquittal. The incident occurred when the man, identified by the surname Luo, allegedly used filming a game machine as a pretext to touch the child's private parts through her pants.

Initially, a district court found Luo not guilty. This decision was based on the argument that the surveillance camera, positioned high and wide-angle, had a blind spot at the crucial moment. Furthermore, the view was obstructed by other shoppers, making it impossible to definitively confirm Luo's actions. The defense argued that any contact was incidental, caused by hand movements or his coat.

However, the Taiwan High Court's Tainan Branch re-examined the evidence. The appellate court noted that Luo did not film the game machine upon returning but instead directed his phone camera toward the girl. The footage showed Luo switching from holding his phone with both hands to one hand as he passed the girl, lowering his left hand towards her. This movement caused the video to shake and angle downwards, suggesting an intentional action rather than a casual pass.

The court also considered the reaction of the girl's family. They were initially looking at their phones but immediately looked up and intently watched Luo's departure after he brushed past the girl. The judges inferred that such a reaction would only occur if the child had experienced something unusual or distressing. This, combined with the re-evaluation of the video evidence, led the court to overturn the initial verdict. Luo was subsequently sentenced to 55 days of detention, which can be commuted to a fine, for intentional sexual harassment of a minor.
