Trump signs orders to limit birthright citizenship, curb 'birth tourism'

President Donald Trump announced Thursday he is again attempting to limit birthright citizenship and curb "birth tourism" through two executive actions. This move signifies the president's determination to pursue these immigration policies, even after a previous attempt to limit birthright citizenship was rejected by the Supreme Court.

The first executive action aims to restrict the number of individuals eligible for U.S. citizenship after being born within the United States. The second order targets "birth tourism," increasing restrictions on foreign nationals seeking to enter the U.S. with the primary purpose of giving birth. Trump stated, "They've taken birthright citizenship and they've made a joke out of it. We're making adjustments because it's very unfair."

The White House later clarified that individuals planning to engage in birth tourism will be denied entry and may face permanent bans. Exemptions for foreign nationals on humanitarian grounds or when their entry is deemed in the national interest may be granted by the Secretary of Homeland Security.

In June, the Supreme Court upheld a broad interpretation of birthright citizenship, affirming that children born on U.S. soil are generally American citizens under the 14th Amendment's Citizenship Clause. This ruling rejected Trump's prior efforts to exclude children born to undocumented or temporarily present individuals. The 14th Amendment states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States."
