US DHS warns migrants: $998 daily fine for failing to leave after deportation order

The U.S. Department of Homeland Security (DHS) has reiterated its policy imposing a $998 daily civil penalty on migrants who remain in the United States after receiving a final deportation order and failing to depart voluntarily. This enforcement action is a component of the current administration's strategy to bolster immigration law compliance.

According to DHS data, the previous administration issued more than 103,000 such sanctions, accumulating over $84 billion in claimed penalties. These fines target individuals who continue to reside in the U.S. after a definitive removal order has been issued. The DHS emphasizes that non-compliance can lead to further consequences, including potential criminal prosecution under Title 8 of the U.S. Code, temporary entry bans, and in some cases, permanent inadmissibility.

Modifications to the penalty imposition process, jointly developed with the Department of Justice, have streamlined the procedure. Notably, the 30-day notification period prior to imposing a fine has been eliminated, and sanctions can now be sent via ordinary mail. The time frame for filing an appeal has also been shortened, aiming to expedite administrative processes related to final removal orders.

"Our message to undocumented immigrants is clear: Leave now! If you do not, you will face the consequences," stated Deputy Secretary Lauren Bis, highlighting the administration's firm stance. As an alternative to these penalties, the DHS actively promotes the use of its mobile application, CBP One. This platform facilitates voluntary departures and offers benefits such as the cancellation of fines related to irregular stays or non-compliance with removal orders, alongside providing free travel arrangements to the migrants' countries of origin.
