Warsaw: 20-year sentence for fatal road accident driver

A Warsaw court has handed down a severe 20-year prison sentence to Łukasz Żak for causing a fatal accident on the Trasę Łazienkowską highway. The ruling also tightens the conditions for his potential early release, reflecting the gravity of his actions and the court's intent to make a strong statement.

Professor Zbigniew Ćwiąkalski, a former minister of justice and lawyer, commented on the verdict, calling it a "harsh sentence" but one that is "socially justified." He noted that Żak's behavior, both at the time of the accident and during the trial, indicated a lack of remorse and a belief that he would receive a lenient punishment. The court, however, did not oblige.

Ćwiąkalski suggested that while the sentence serves as a "good lesson" for other drivers, it might not deter everyone. He acknowledged that despite severe penalties for certain offenses, some young people continue to drive recklessly. The court's detailed explanation of its reasoning, moving beyond legal jargon to address the public directly, was seen as a positive step in making judicial decisions more understandable.

The former minister also touched upon the concept of proportionality in sentencing, warning that excessively harsh punishments can sometimes lead to public sympathy for the offender. He emphasized the importance of swift and fair justice, stating that sentences should be delivered promptly rather than after years of legal proceedings.
