25 Democratic States Sue U.S. Government Over Trump Tariffs

A coalition of twenty-five Democratic-led states has filed a lawsuit against the federal government, challenging President Donald Trump's recent tariff policy. The states contend that the broad tariffs, imposed on July 23 on goods from 60 trading partners, exceed presidential authority. They argue that the administration's justification for the tariffs, addressing forced labor in international supply chains, lacks a rational connection to the generalized measures. The lawsuit, filed in federal court, asserts that the investigations conducted by the Office of the U.S. Trade Representative (USTR) under Section 301 of the Trade Act of 1974 were "a sham and illegal effort to exercise unfettered tariff power." The states claim these investigations were hurried and prejudiced from the outset. While opposing forced labor, the states argue the administration is using it as a pretext for an unlawful tariff scheme. This legal challenge comes as Trump has consistently used tariffs to reshape global trade since taking office, aiming to secure new trade deals by leveraging tariffs against allies and adversaries alike. A previous round of tariffs was invalidated by the Supreme Court, and the current measures replace an earlier 10% global tariff that expired in July.
