Bergama Court Orders Public Notice in Heirship Case

The Bergama 1st Civil Court of First Instance in Turkey has issued a public announcement for several defendants in a lawsuit concerning the cancellation of heirship certificates. The plaintiffs, including Emine Atmaca, Fatma Şahin, Fikret Şahin, Halide Buga, Hatice Demirel, Sibel Mülayim, and Zübeyde Metin, are seeking to invalidate heirship certificates issued to defendants led by Hazal Ceren Şen and Nuray Şen.

Summons were sent to the defendants' addresses abroad, but the notifications could not be delivered. The local Civil Registry Directorate also could not confirm their previous addresses, prompting the court to order a public announcement of the lawsuit and the preliminary hearing order. This measure is in accordance with articles 127-128 of the Code of Civil Procedure.

Under these legal provisions, the defendants have a period of two weeks from the date of this announcement to submit their response. Failure to do so will result in them being considered to have denied all the factual claims made in the lawsuit. The court's decision to proceed with a public announcement underscores the difficulty in locating and serving the defendants.
