Businessman's conviction for assaulting, insulting guard upheld; sentenced to five years

A businessman convicted of insulting, threatening, and assaulting a security guard will serve five years in prison after the High Court upheld his conviction and sentence. Chung Chee Yang, 48, was ordered to begin his sentence immediately.

The High Court judge, Datuk Seri Shamsulbahri Ibrahim, dismissed Chung's appeal against his conviction and the original sentence of six years and 10 months. The judge found no errors in the Magistrate's Court decision, stating the sentence was within the legal limits and fitting for the offenses committed.

I find that the sentence imposed by the Magistrate's Court is within the limits allowed by law and is very (appropriate) for the offense committed.

Chung was found to have assaulted two security guards, Mohd. Azminizam Zulkepli and Ahmad Shamsuri Zailani, and threatened them with a firearm. He also allegedly made insulting remarks towards them while they were fasting during Ramadan.

There is no reasonable grounds for me to intervene in changing the sentence by the Magistrate's Court. In conclusion, I dismiss the appeal for conviction and sentence, however, I allow the separate prison sentences from before to be served concurrently starting today.

During the incident, Chung reportedly slapped and punched the guards, questioning their faith and loyalty, asking if their God could provide them with money or if they preferred working for him. The court ordered his previous separate prison sentences to be served concurrently, reducing the total effective jail time.

In March of the previous year, the Klang Magistrate's Court had sentenced Chung to six years and 10 months in prison and fined him RM22,000 for the three charges. The defense failed to raise reasonable doubt against the prosecution's case.
