China's New Exit Rules Could Restrict Taiwanese Travelers, Analyst Says

Taiwanese travelers may face increased uncertainty when visiting China following Beijing's introduction of new regulations that grant the government expanded powers to restrict cross-border movement. These rules, set to take effect on September 15, broaden the scope of government oversight to encompass people, technology, information, and social networks.

Hung Pu-chao, deputy head of Tunghai University's Center for Mainland China and Regional Development Research, explained that the regulations represent a comprehensive framework for managing cross-border activities, extending beyond traditional border controls to encompass national security. Under the new rules, Chinese immigration authorities can advise citizens against traveling to designated high-risk countries or regions. Travelers must provide truthful reasons for leaving China, and authorities can question their stated purposes and inspect electronic devices.

The regulations establish a comprehensive framework for managing cross-border activities.

Provincial governments will have the authority to impose exit bans of up to three years on citizens returning from overseas if their activities are deemed harmful to China's national security or interests. Individuals violating export controls or technology trade regulations, and considered potential threats to China's industrial or technological security, could also face exit bans imposed by various government agencies.

Hung highlighted that the regulations could significantly impact Taiwanese individuals traveling to or engaging in exchanges with China due to the increased unpredictability. The rules grant authorities broader administrative discretion, and some provisions lack clear definitions for circumstances that might trigger government intervention. This ambiguity makes it difficult for travelers to ascertain in advance whether their activities could lead to scrutiny or restrictions. Hung warned that Taiwanese citizens currently in China could potentially face enforcement measures or exit restrictions.
