Constitutional Court's 'Fritz case' justification sparks outrage, fears of 'PSD-AUR dictatorship'

Romania's Constitutional Court (CCR) has issued a justification for its decision in the "Fritz case" that has drawn sharp criticism from legal experts and former officials. The court's ruling, supported by five judges including three appointed by the Social Democratic Party (PSD), has been described as an "intellectual shame" and "extremely dangerous" by former Justice Minister Ana Birchall.

Legal specialist Cristi Danileț expressed bewilderment, stating the justification was incomprehensible and that legality had been surpassed. Former presidential advisor Iulian Fota warned of "major legal insecurity," while lawyer Adrian Toni Neacşu found the motivation "unconvincing and clumsy," predicting it would fuel further debate rather than resolve it.

Critics allege that a faction within the CCR prioritizes political interests over legal science. They point to past decisions, such as annulling Diana Șoșoacă's presidential candidacy despite no criminal conviction, and suggest the court influenced the December 2024 presidential election outcome. The current ruling on Fritz is seen as further evidence of this disregard for legal principles.

The article warns that if PSD and the AUR party, along with the CCR and the justice system, consolidate power, it could lead to a "dictatorship." This consolidation, it argues, would jeopardize European funds and investor loans, as a Grindeanu-led government might resort to heavy taxation on multinationals and progressive taxation, potentially leading to economic decline and a "junk" credit rating.
