Court orders NDLEA to produce social media influencer KC Luxury in Lagos

Justice Friday Ogazi of the Federal High Court in Lagos has issued a critical order compelling the National Drug Law Enforcement Agency (NDLEA) to present Lagos social media influencer and businessman Kazeem Afolabi, widely known as “KC Luxury,” before the court. This directive comes in response to allegations that Afolabi has been held incommunicado for 14 days without being formally charged with any offense.

The court's order was made following an ex parte application submitted by Afolabi's counsel, A. Labi-Lawal, SAN, invoking the Fundamental Rights (Enforcement Procedure) Rules of 2009. The court has also mandated the NDLEA to provide a response within five days to the application challenging Afolabi’s continued detention. The agency must show cause why the influencer should not be released or granted bail.

Afolabi was reportedly arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport in Lagos as he was preparing to travel to Paris. According to an affidavit deposed by his father, Eric Afolabi, the applicant has remained in NDLEA custody since his arrest. Crucially, he has not been informed of the offense for which he is being held, nor has he been brought before a competent court of jurisdiction.

In the substantive application, Afolabi's legal team seeks declarations that his prolonged detention without formal charges constitutes an unconstitutional violation of his fundamental rights as guaranteed by Nigeria's 1999 Constitution. They are further requesting an order for his immediate release or, alternatively, for him to be admitted to bail on liberal terms pending the filing of any potential charges. The application also details allegations of a search of Afolabi's residence without a warrant and the seizure of his iPhone 15, with operatives allegedly threatening him for the device's password.
