Cristina Kirchner turns to UN to overturn conviction, mirroring Lula's strategy

Former Argentine President Cristina Kirchner is pursuing a novel strategy to overturn her conviction and permanent disqualification from public office, seeking a recommendation from the UN Human Rights Committee. This move mirrors tactics previously employed by Brazil's ex-president Lula da Silva.

Kirchner's legal team, including newly hired Brazilian lawyer Rafael Valim, who is also linked to Lula's legal defense, plans to present her case to the UN committee in Geneva. This international appeal aims to secure a ruling that could influence the annulment of her sentence in Argentina.

This strategy appears to sideline other proposed avenues, such as a request to the Argentine Supreme Court, supported by politician Miguel Ángel Pichetto, or an appeal to the Inter-American Commission on Human Rights (IACHR), which Kirchner had previously utilized for a different case.

The legal strategy is set to be announced by Kirchner's lawyers, Alberto Beraldi and Rafael Valim, alongside Spanish human rights litigation specialist Javier Borrego. The UN Human Rights Committee, composed of 18 independent experts, issues opinions and recommendations rather than binding orders to member states.

Kirchner's move comes amid ongoing political maneuvering, with her son Máximo Kirchner reportedly threatening to launch his mother's presidential candidacy if Governor Axel Kicillof does not negotiate candidate lists favorably. The conviction, related to alleged fraudulent administration against the state, carries a six-year prison sentence and a lifetime ban from holding public office, a penalty paradoxically included during a previous Kirchnerist administration.
