Guatemala trial begins for activist murdered two decades ago

A Guatemalan court has commenced the trial of Selvin Geovani Arana Esquit, accused of the 2004 murder of human rights activist Florentín Gudiel Ramos. The trial begins nearly 22 years after the killing, a delay that drew criticism from the Inter-American Court of Human Rights (IACHR) in 2014, which found the Guatemalan state responsible for a lack of investigation.

Makrina Gudiel, the victim's daughter and a plaintiff in the case, testified before the court, recounting the persecution her father faced. Gudiel, who dedicated his life to social pastoral work and community projects, was executed by two men on bicycles on December 20, 2004. His daughter seeks justice as a form of reparation and to prevent similar incidents.

The Public Ministry and the human rights defenders' protection unit (UDEFEGUA) are seeking a conviction, citing the principle of conventionality to ensure the ruling respects international human rights treaties. The defense attorney requested adherence to due process and the presumption of innocence, while the accused opted not to testify.

The court has suspended the proceedings and rescheduled the debate for September 1, when evidence presentation will continue before a verdict is delivered. Florentín Gudiel was a member of the Guatemalan Revolutionary Unity (URNG) and a community leader recognized for his human rights advocacy. Guatemalan President Bernardo Arévalo de León has emphasized his administration's commitment to protecting human rights defenders, referencing a public policy initiative launched in response to the IACHR's 2014 resolution concerning Gudiel's murder.
