Indecopi Seizes and Fines 5 Companies S/ 414,000 for Selling Illegal Pokémon, Disney, Cartoon Network, and Peanuts Products

Peru's National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has levied significant fines totaling S/ 414,370 against five companies for illegally importing and distributing products bearing unauthorized characters. These characters include popular figures from Pokémon, Disney, Cartoon Network, Peanuts, and Sanrio.

The penalties, confirmed in the final administrative instance by Indecopi's Intellectual Property Specialized Chamber, amount to 75.34 UIT collectively. Beyond the financial penalties, Indecopi mandated the confiscation of the infringing goods and, in some cases, their handover to the legitimate rights holders. The companies were also ordered to cover legal costs.

J & H Global Business S.A.C. received the largest fine of 40.56 UIT for importing 3,000 smartwatches featuring Snoopy, the beloved Peanuts character, without authorization. Innovaciones Carmely S.A.C. was fined 24.73 UIT for importing 800 pyrotechnic items displaying Billy, from "The Grim Adventures of Billy & Mandy," a Cartoon Network property.

Other sanctioned companies include Asia Company S.A.C. (7.40 UIT) for importing dolls resembling Disney's Anna and Elsa; Meyten S.A.C. (2 UIT) for distributing handkerchiefs with Sanrio's Keroppi; and Corporación Dehusa Sile S.A.C. (0.65 UIT) for importing 5,000 metallic balloons featuring Pokémon characters Pikachu and Squirtle. Indecopi reiterated that intellectual property rights must be respected, prohibiting the reproduction, import, distribution, or sale of protected creations without explicit permission.
