Indonesian lawmakers okay reserve component requirement for amnesty recipients

Indonesia's House of Representatives Commission I has indicated it will not object to former inmates being required to join the reserve components program as a condition for receiving amnesty on August 17. Dave Laksono, Deputy Chairman of Commission I from the Golkar Party Faction, stated that the requirement for participation in the reserve components program is entirely within the government's or the President's authority.

Laksono explained that this condition is intended to ensure that former inmates retain their national spirit and discipline after their release. "There will be certain requirements for amnesty recipients, including participation in a development program like the Reserve Components, which is certainly part of the government's policy," he told reporters.

He affirmed support for the plan, provided the amnesty is granted in accordance with legal provisions. Laksono noted that amnesty is fundamentally a constitutional right of the President, as stipulated in Article 14, Paragraph (2) of the 1945 Constitution, though the President requires parliamentary consideration for its execution. "This means that although it is the President's authority as head of state, its implementation remains within the framework of the constitution and involves a checks and balances mechanism through parliamentary consideration," he added.

Minister of Immigration and Corrections Agus Andrianto previously announced that President Prabowo Subianto is preparing to grant amnesty to correctional facility inmates on August 17. However, recipients must first complete the reserve components program. Andrianto stated that amnesty is a concrete government effort to address overcrowding in prisons and detention centers across Indonesia. "Hopefully, the President, as I mentioned earlier, will grant amnesty to inmates under 35 years old this August. But they won't be released immediately; they will join the reserve components to instill discipline," he said.
