Labor Unions Rebuke President Lee Over Narrowing Scope of Disputes

President Lee Jae-myung's recent comments suggesting that the scope of labor disputes should be narrowed and that the government should set clear standards have ignited strong opposition from South Korea's two largest labor federations, the Federation of Korean Trade Unions (FKTU) and the Korean Confederation of Trade Unions (KCTU).

The FKTU issued a statement asserting that the revised Trade Union Act allows for negotiations and labor disputes concerning management decisions that affect working conditions. They warned that if the government attempts to limit the scope of labor disputes through enforcement decrees or administrative guidelines, it would effectively curtail the labor rights that the National Assembly expanded through legislation. The FKTU also criticized the president's framing, stating that not every management decision automatically constitutes a labor dispute and that exaggerating this point only fuels unnecessary misunderstanding and social conflict.

Similarly, the KCTU condemned the president's remarks as a "biased and distorted view of labor relations." The union argued that issues such as new factory construction or production line relocation are directly linked to working conditions and that it is natural for labor and management to discuss them. They criticized the president's definitive statements, made without considering the context and details of specific cases, as a "dogmatic idea" that could stifle opportunities for autonomous dialogue and negotiation between labor and management.

Regarding demands for profit-sharing and performance-based bonuses, the KCTU pointed out that the distribution of profits as wages or bonuses has long been a subject of negotiation between labor and management. They expressed concern that the government's attempt to control complex labor relations with simple guidelines would only amplify conflict and uncertainty.

President Lee's comments were made in response to the Samsung Electronics union's intention to include the company's semiconductor investment plans in future collective bargaining and labor's push for performance-based bonuses tied to operating profits. The president suggested that these issues might not fall under the scope of legitimate labor disputes and proposed establishing clear criteria through decrees and guidelines from the Ministry of Employment and Labor.
