Lawmaker loses defamation suit over 'traitor' comments

Taiwanese legislator Lai Shi-pao has lost a defamation lawsuit against a constituent who publicly labeled him a "traitor," "running dog," and "selling out the country" on Facebook. Lai had sought NT$1 million (approximately $31,000 USD) in damages, arguing that the remarks by Lin Chi-chun, an initiator of a recall movement against Lai, severely damaged his reputation.

Lin had posted a lengthy critique on a Facebook page, outlining five specific reasons for the recall effort against Lai, a member of the Kuomintang party. These reasons included accusations of favoring the Chinese Communist Party, disregarding national security, obstructing defense construction, ignoring public opinion and constituency needs, and betraying Taiwan's international image and democratic values. Lin argued that his comments were a strong condemnation of Lai's actions, stemming from his own views and position, and were protected under freedom of speech.

The Taipei District Court sided with Lin, stating that the context of the posts indicated criticism of Lai's political leanings, his stance on defense budgets, and his position on the Chinese Communist Party's actions. The court found that these criticisms, while harsh, were related to potential threats to national security and democratic systems. It concluded that Lin's comments aimed to foster public discussion on important issues and possessed strong public interest, rather than being mere baseless insults.

The judge further noted that as a long-term political figure, Lai's actions are subject to public scrutiny, which is a normal aspect of society. The court determined that Lai was not at a disadvantage in the public discourse and could express his stance through his political achievements. While acknowledging that Lin's wording might have caused Lai displeasure, the court ruled it did not exceed a range that ordinary people could reasonably tolerate. Balancing the function of public opinion in promoting discourse with the reputation rights of public figures, the court prioritized the protection of political speech.
