Lawsuit against Trump administration: 'Sanctions on ICC are an illegal abuse of power'

Several human rights organizations have taken legal action to contest sanctions imposed by former U.S. President Donald Trump's administration against the International Criminal Court (ICC). The lawsuit, filed Tuesday in New York, argues that these sanctions are an illegal abuse of power and an attack on the rule of law.

Four organizations, including Human Rights Watch, the American Friends Service Committee, the Center for Constitutional Rights, and the Open Society Institute, assert that the sanctions violate fundamental rights, particularly the First Amendment's protection of free speech. Their complaint states that the restrictions "severely compromise the ability to prosecute perpetrators of genocides, war crimes, and crimes against humanity."

The organizations contend that the sanctions constitute an "illegal abuse of power" and a direct assault on judicial independence. They argue that the sanctions undermine the fundamental principles of international law and equal access to justice. The groups also claim they have been forced to limit their interactions with the ICC for fear of incurring penalties.

The lawsuit names not only Donald Trump but also former Secretary of State Marco Rubio, former Treasury Secretary Scott Bessent, and former Attorney General Todd Blanche as defendants. The Trump administration previously imposed sanctions on four ICC judges in 2020, with Rubio stating they were a response to the court's "illegal and baseless actions targeting America or Israel."

The ICC has condemned the U.S. measures as an attempt to undermine its independence. The sanctions were reportedly enacted via an executive order in February 2025, accusing the court of "illegitimate and baseless actions targeting America and our close ally, Israel." The court has recently issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas leader Ibrahim Al-Masri in connection with alleged war crimes and crimes against humanity in Gaza.
