Lithuanian waste company "Energesman" to sue after being blacklisted

The Vilnius Regional Waste Management Center (VAATC) has placed "Energesman," the former operator of the Vilnius mechanical-biological treatment (MBT) plant, on its list of unreliable suppliers. In response, "Energesman" has announced its intention to challenge this decision legally.

Algirdas Blazgys, director of "Energesman," stated that the company disagrees with the basis for their inclusion on the list and will appeal to the court. He also noted that "Energesman" is contesting VAATC's decision to terminate the plant's modernization contract. Blazgys maintains that the modernization contract remains valid, asserting there was no factual or legal justification for its termination.

We do not agree with the grounds stated by VAATC for including us in the List of Unreliable Suppliers, therefore we will appeal the decision to the court.

"Energesman" filed a lawsuit on August 10th regarding the contract termination, information that Blazgys claims VAATC was aware of when they added the company to the unreliable suppliers list on August 14th. The company argues that VAATC failed to disclose this ongoing legal dispute in their listing.

The VAATC added "Energesman" to the list until July 9, 2029, citing unfulfilled obligations by the private operator. This led to a legal dispute, with a court order in late July preventing "Energesman" from obstructing VAATC's access to the plant. VAATC has since taken over the plant's operations. "Energesman" estimates its losses at approximately 20 million euros, a figure expected to rise.

The legality of the termination of the modernization contract is being challenged in court. VAATC did not indicate in the list that we had filed a lawsuit regarding this contract termination, although they should have filled out such a section, as they were aware of the court proceedings – we filed the lawsuit on August 10, and VAATC included us in the list on August 14.
