Major Convicted in State Fraud Case Remains Under House Arrest

Army Major Raúl Alejandro Girón, a key figure in a corruption case involving over 4.5 billion pesos in state fraud, remains under house arrest after his bid to have the restriction lifted was rejected. Girón had sought a habeas corpus writ to end his confinement, but the Fourth Criminal Chamber of the National District declared his request "inadmissible."

The judge cited that the execution judge acted correctly in refusing to calculate Girón's sentence. This decision stems from the fact that the conviction by the First Collegiate Court of the National District in May, which sentenced Girón to five years for "time served" due to his extended house arrest, is not yet a final judgment. The full sentence has not been read, and thus, has not been formally notified to the parties involved.

Girón gained notoriety for his testimony detailing the corruption scheme within the Presidential Security Corps (Cusep) and the Tourist Security Corps (Cestur). Despite his cooperation with the Public Ministry, which led to the prosecution's request for "time served," the legal process is ongoing. The full reading of the sentence for Girón and other military officials, including Major General Adán Cáceres Silvestre (sentenced to 20 years), is scheduled for August 14, with the appeal period beginning the following day.

The judge of the Fourth Criminal Chamber, Franny González, suggested that Girón should pursue other legal avenues. The First Collegiate Court is scheduled to hear a separate request regarding the cessation of the coercive measure imposed on Girón five years ago. This legal complexity means Girón's house arrest continues despite the initial sentencing.
