Mexican Official Fined, Banned from Contracts for False Information

The Mexican Secretariat for Anticorruption and Good Governance has imposed a significant penalty on Eliana Díaz Magaña, an official within the Mexican Social Security Institute (IMSS). Díaz Magaña has been fined 138,911 pesos and barred from participating in federal public procurement processes or entering into contracts with the Federal Public Administration for a period of two years.

This sanction was issued by the Internal Control Body at IMSS. The disciplinary action arises from false information provided by Díaz Magaña concerning 120 units of the medication identified as "Limustin Tacrolimus," specifically lot I20J0121. These discrepancies occurred during the validity period of three purchase orders signed in August 2021.

An investigation revealed that the 120 units were presented and labeled as Tacrolimus 1 mg. However, their actual content did not match the medication indicated on both the primary and secondary packaging. This misrepresentation constituted a violation of procurement regulations and public trust.

The notification of this sanction was made on July 31, with its official publication occurring in the Official Gazette of the Federation on August 11. Consequently, Díaz Magaña has been added to the Directory of Sanctioned Suppliers and Contractors, effectively prohibiting her from engaging in new government contracts.

The Secretariat emphasized that these measures were implemented in accordance with the law, considering proportionality and the severity of the offense. The official retains the right to appeal this decision, and the Secretariat stated it would firmly defend the sanction if challenged, asserting that it was imposed legally and in protection of the public interest.
