Michael Clark and 10 Others to Face Formal Charges in "Caso Sartor"

Michael Clark, the former president of the football club Azul, is scheduled to be formally charged this Thursday along with 10 other individuals in connection with the "Caso Sartor" (Sartor Case). The prosecution, led by the Metropolitan Oriente Oriente Prosecutor's Office under prosecutor Juan Pablo Araya, requested the charges at the Fourth Guarantee Court of Santiago.

The proceedings, set to begin at 9:00 AM local time, will present accusations for a range of financial crimes. These include disloyal administration, incompatible negotiation, providing false information to the market, fraud, evasion of a public takeover bid for shares, and money laundering. According to the prosecution's filing, these alleged offenses began in January 2020 and have continued up to the present.

The list of executives facing charges is headed by Pedro Pablo Larraín Mery, the former president of Sartor. Among the 11 defendants, eight, including Clark, have previously faced sanctions, such as substantial fines and disqualifications, imposed by the Financial Market Commission (CMF). This indicates prior regulatory scrutiny of their actions.

During the investigation, the accused reportedly displayed varied responses. Clark, also known for his past role as president of the Universidad de Chile club, testified three times. He reportedly sought to distance himself from the operational management of Pedro Pablo Larraín, claiming no friendship and stating his involvement in 2019 was as an external consultant. He also questioned internal financial operations despite his participation. Clark asserted his relationship with Sartor executives was "strictly professional" and denied attending social events or corporate trips.

Other defendants have also provided statements. Alfredo Harz Castro reportedly pointed directly at Pedro Pablo Larraín and discussed the purchase of Azul Azul from Carlos Heller, revealing the role of Victoriano Cerda, the former owner of Huachipato. The case involves complex financial dealings and alleged misconduct spanning several years.
