Neighbor sentenced to 25 years for murder over apartment noise

A man has been sentenced to 25 years in prison for fatally stabbing his elderly neighbor in an apartment building over noise complaints. Yang Min-jun, 47, was found guilty of murder and property damage by the Daejeon District Court's Cheonan Branch.

The incident occurred on December 4 last year when Yang, residing in an apartment in Cheonan, South Chungcheong Province, attacked his 79-year-old upstairs neighbor, identified only as Mr. K, with a knife. The victim, injured, fled to the apartment management office, but Yang pursued him, broke through the office door with his vehicle, and attacked him again. Investigators determined Yang committed the crime due to the noise from construction work in Mr. K's apartment.

Yang claimed the act was impulsive, but the court did not accept this. His defense of diminished mental capacity was also withdrawn after a court-ordered psychiatric evaluation found no signs of mental disorder. The court noted that Yang waited for another person to move out of the way before ramming the management office door with his car, indicating a degree of planning.

The sentence is too light compared to the crime. We are so disappointed that nothing has been recovered for the victim, and we will do everything we can to ensure the maximum sentence is handed down.

The court stated that the defendant brutally murdered an elderly victim, and his attempts to blame the victim or claim memory loss during the trial raised doubts about his genuine remorse. However, Yang's full confession before the sentencing and his lack of prior criminal convictions beyond fines led to a sentence less severe than the life imprisonment and 30-year electronic monitoring sought by the prosecution.

Following the sentencing, the victim's family voiced their disappointment, stating the sentence felt too light given the crime and that they would pursue all available options to seek the maximum penalty. Legal representatives for the victim's family are also considering civil lawsuits against the Korea Land and Housing Corporation (LH) and the Housing Management Corporation, arguing that earlier relocation could have prevented the crime.
