PNL Statute Case Postponed at Bucharest Tribunal After Two Judges Withdraw

The Bucharest Tribunal has postponed discussions regarding the National Liberal Party's (PNL) request to approve its new statutes, adopted at the party's extraordinary congress on June 21. The delay stems from two judges successively recusing themselves from the case.

This legal hurdle follows a previous decision on July 8, when the tribunal suspended all resolutions from the PNL's extraordinary congress. The court cited that these resolutions were based on a modified statute that had not yet received judicial approval. This suspension came after internal party members contested the congress's proceedings, arguing that decisions, including leadership elections and statute modifications, were made under legally ineffective provisions.

Initially, Judge Mihaela Luciani requested recusal on July 16, leading to the case being reassigned to Judge Evelina Vîlcu. However, Judge Vîlcu also filed a recusal request, which was accepted by the Bucharest Tribunal on Monday, necessitating the file's transfer to another magistrate.

The tribunal's suspension of the congress's decisions is provisional, aimed at preventing legal consequences until a final ruling on the congress's legality. Key decisions affected include the re-election of Ilie Bolojan as party leader, statute amendments, political resolutions, and subsequent decisions made by the National Permanent Bureau based on these. Consequently, the PNL announced on July 9 that it would temporarily operate under its old statutes, adopted in July 2025.

In response to the legal challenges, PNL leadership intends to convene a new congress, likely in August or September. Daniel Fenechiu, leader of the PNL senators, stated that the party has the necessary majority to organize a new National Council and congress to adopt a statute that will be more resilient to legal contestation. This move aims to ensure the party's stability and operational continuity amidst ongoing legal scrutiny.
