Poland Drops Gas Station Alcohol Ban, Implements Night-Time Sales Restriction

A proposed ban on alcohol sales at gas stations in Poland has been removed from a legislative amendment, following objections from both the government and the President's Chancellery. Initially, the ban was a key element in draft legislation proposed by the Lewica and Polska 2050 parties.

Lawmakers supporting the ban, like Wioleta Tomczak of Polska 2050, argued that it is crucial for individuals struggling with alcoholism. She cited research indicating that 70% of drivers with alcohol problems admitted to purchasing alcohol at gas stations, and 50% confessed to consuming it immediately before driving. These findings were based on studies conducted by the "Trzeźwość" Foundation and the "Wschodzące Słońce" Foundation.

However, arguments from the fuel industry played a significant role in the decision. The Polish Organization of Oil Industry and Trade (POPiHN) contended that excluding gas stations would be discriminatory compared to other alcohol distribution channels. They pointed out that out of approximately 119,000 alcohol retail points in Poland, only about 5,500 are gas stations, suggesting a limited impact of such a ban on overall alcohol availability. The Polish Gas Station Association (PGP) further noted that gas stations account for only about 2% of the alcohol market share and that their prices are often higher than those in grocery stores or discounters.

While the gas station ban was abandoned, a compromise was reached: a nationwide night-time prohibition on alcohol sales. This ban will be in effect daily from 10 p.m. to 6 a.m. and will include gas stations, similar to existing local night-time bans.
