Romanian man demands half of ex-wife's breast implant cost in divorce settlement

In a bizarre turn of events, a Romanian court has heard a divorce case where the ex-husband demanded half the value of his former wife's breast implants be included in the division of assets. The man argued that he had personally funded the cosmetic surgery during their marriage and sought to recoup a portion of the investment.

Today we received a ruling in a civil partition case so memorable that I believe civil law should receive an Oscar for comedy from time to time. Because it's not every day that an ex-husband requests, in a partition, with utmost seriousness, that the ex-wife's breast implant be divided.

The unusual legal battle was brought to light by lawyer Constantin Neacșu, who shared the case on his TikTok account, describing it as one of the most memorable partition proceedings he has encountered. "Life imitates film, and film beats any law textbook," Neacșu remarked, emphasizing the surreal nature of the request.

Neacșu explained that his client's intention was not to physically claim the implants but to have the cost of the procedure recognized as a shared expense. However, the court sided with the legal principle that the human body is inviolable and not subject to civil exchange or division.

The human body is inviolable, it is not in the civil circuit, it is not divisible property. We cannot put the prosthesis on the court's table like a television. The expense is consumed like a treatment, like a massage, like a waxing. It's gone.

The judge ruled that the implants could not be treated as common property, like a television or a car, which can be evaluated and divided. The court determined that the expense was personal to the ex-wife, akin to a treatment or massage, and therefore not part of the couple's shared patrimony. The case was ultimately dismissed, with the court upholding the notion that body modifications are strictly personal and cannot be partitioned, evaluated, or auctioned.

As I said, the court, calm, with that air of 'I can't believe we're discussing this,' noted exactly what the law says: the implant is strictly personal property, part of the person's body. It cannot be divided, evaluated, claimed, removed, moved, transferred, amortized, or put up for auction. And so closed one of the most uplifting cases of my legal career.
