Santiago pub fined over 10 million pesos for excessive noise

A pub in Santiago's affluent Las Condes district has been ordered to pay a substantial fine for persistent noise violations.

Flannery's Irish Geo Pub, located at Encomenderos 179, will pay more than 10 million pesos after the Second Environmental Court upheld a sanction imposed on the establishment. The court's decision confirmed that the pub had exceeded legal limits for noise emissions.

The pub's appeal against the fine, which amounted to 12 annual tax units, was dismissed. The court found no legal irregularities in the administrative process, verifying that background noise levels were considered appropriately and that the excess decibel level of 12 dBA was accurately measured.

Furthermore, the court acknowledged that the determination of a medium risk level incorporated the magnitude of the noise excess, the nighttime hours, and the duration of exposure. The assessment indicated that approximately 1,715 people could have been potentially exposed to the excessive noise.
