Trump administration faces lawsuit from Democratic states over tariffs

A coalition of 25 Democratic-led U.S. states has filed a lawsuit against the federal government, challenging President Donald Trump's recent tariff policy. The states contend that the administration's imposition of widespread tariffs, ranging from 10% to 12.5% on 60 trading partners, exceeds the president's legal authority.

The tariffs were announced on July 23, following an investigation that accused trading partners of facilitating the supply of goods from countries using forced labor. However, the states argue in their lawsuit that "there is no rational relationship between the alleged problem of forced labor in international supply chains and the generalized global tariffs" imposed by the Office of the U.S. Trade Representative (USTR).

White House spokesperson Kush Desai defended the administration's actions, stating that "the United States is using its legal authority to achieve the elimination of policies, unreasonable acts, and practices that harm U.S. trade." The U.S. government believes many trading partners, including the European Union, do not adhere to the same standards in combating forced labor as the United States.

The lawsuit asserts that the USTR's investigations under Section 301 of the Trade Act of 1974 were a "sham and illegal effort to exercise unrestricted tariff power." The states argue that the administration cannot use forced labor as a pretext for its tariff scheme, especially after the Supreme Court previously limited presidential powers on tariffs. The success of this new legal challenge remains uncertain, as the Trump administration has utilized available mechanisms following the Supreme Court's ruling.
