Turkish Family Court Orders Public Notice for Defendant in Divorce Case

Izzeddin Beyazi is the subject of a divorce lawsuit filed by his spouse at the Hatay 4th Family Court in Turkey. The court previously issued a summons to Beyazi at his registered address (Akevler Mahallesi, 31 Sokak, No: 44, Antakya/Hatay). However, the summons could not be delivered because Beyazi had moved from that address, and subsequent address inquiries also failed to locate him.

As a result, the court has ordered that the lawsuit petition, the interim decision, and the hearing date be officially published. Beyazi is required to submit a formally prepared response to the lawsuit within two weeks of this notice, in accordance with Articles 122, 126, and 129 of the Turkish Code of Civil Procedure (HMK). This response must include any preliminary objections and evidence. Failure to do so will result in him being considered to have denied the plaintiff's claims and waived his initial objections.

The court also requires Beyazi to deposit the necessary advance fees for the production of any evidence he intends to submit. The hearing is scheduled for October 8, 2026, at 10:05 AM. Beyazi must appear in person or be represented by legal counsel. If he fails to attend, the trial will proceed in his absence, the investigation phase will conclude, oral arguments will commence, and a judgment will be rendered without his participation.
