US Federal Court Blocks Trump’s Latest Bid to Restrict Birthright Citizenship

A US federal judge has blocked President Donald Trump’s latest attempt to narrow birthright citizenship, finding that the policy likely conflicts with the Supreme Court’s ruling against his broader effort.

US District Judge Deborah Boardman’s preliminary injunction prevents the administration from enforcing the newer policy against the certified class of legal challengers. Federal agencies can still prepare guidance on how the order would operate.

Boardman said the order covers children who could have been denied citizenship under Trump’s first executive action. “If not enjoined as to the class, the 2026 Executive Order could deny the right to citizenship by birth to children whom the Supreme Court declared were citizens,” she wrote.

Trump issued the narrower action in August after the Supreme Court rejected his earlier order. The first order sought to deny citizenship to babies born in the United States when their parents were unlawfully present or visiting under temporary status.

The newer policy would prevent federal agencies from recognizing citizenship for children whose parents are not US citizens if either parent is classified as “an alien enemy,” works for a foreign government, or is involved in so-called birth tourism. A separate challenge to the policy remains pending in New Hampshire.
