Vietnam's Lam Dong allows construction on agricultural land for production support

Agricultural land users in Vietnam's Lam Dong province will soon be permitted to construct facilities directly supporting agricultural production. Decision 54/2026/QD-UBND, issued by the provincial People's Committee and effective August 20, 2026, outlines specific conditions for these constructions.

The land must be registered, and the total agricultural area used by the owner must be at least 500 square meters. This area can comprise one or several adjacent plots owned by the same individual. Crucially, the construction must not interfere with irrigation systems, dykes, or internal farm roads, nor impact adjacent agricultural land.

The size of the permitted structure is directly proportional to the land area. For plots between 500 and 5,000 square meters, the maximum construction area is 25 square meters. This limit increases to 50 square meters for plots between 5,000 and 10,000 square meters, and 75 square meters for those between 10,000 and 20,000 square meters.

Larger landholdings allow for more extensive facilities. Plots exceeding 20,000 square meters can have up to 100 square meters of construction. For areas between 50,000 and 100,000 square meters, the maximum is 200 square meters. Landowners with over 100,000 square meters can build up to 300 square meters, and those with more than 300,000 square meters can construct facilities up to 500 square meters. These structures do not need to be in a single location, but their total area must not exceed the stipulated maximums.

This regulation builds upon a previous management approach in Lam Dong, where Decision 24/2024/QD-UBND set similar limits. It is important to note that these provisions are for structures supporting agricultural production and do not permit residential construction on agricultural land.
