Woman Sentenced to 7 Years for Fatal Car Chase After Victim Falls, Gets Run Over

A woman in Taiwan has been sentenced to seven years and four months in prison for causing the death of a man who was trying to de-escalate a dispute between her and her girlfriend. The incident occurred in August 2022 when the defendant, identified as Peng, argued with her girlfriend, Huang, in Yangmei District.

The victim fell off the car after it had traveled 105 meters and lay on the ground, unable to move. About two minutes later, he was run over by an oncoming vehicle and died.

Following the argument, Huang's friend, identified as Peng, intervened. As Huang drove away, the defendant, Peng, pursued her in her own vehicle. In an attempt to prevent the chase, the victim climbed onto the hood of the defendant's car, gripping the windshield wipers. Despite the man's precarious position, the defendant continued to drive.

After approximately 105 meters, the victim fell from the car and was subsequently run over by an oncoming vehicle, resulting in his death. Prosecutors charged the defendant with causing death by injury, arguing that while she did not intend to kill him, her decision to continue driving with a person on her hood created a direct causal link to his death.

Although the defendant subjectively did not have a direct intent to kill, and the fatal crushing was not caused by her, she knew someone was on the front of the car and still drove forward, which has a causal relationship with the victim being run over by another vehicle.

The court acknowledged that the defendant's actions were primarily motivated by a desire to retrieve her girlfriend, not by malice towards the victim. However, the court also emphasized the tragic outcome, the profound grief inflicted upon the victim's family, and the danger posed to other road users. The defendant's personal circumstances, including a history of non-violent offenses, a difficult childhood, and limited social connections, were considered. She was also credited for calling the police and cooperating with the investigation, though she had not provided any compensation to the victim's family, who expressed no desire for mediation.
