Defendants in deadly shipyard explosion case sentenced to 1-2 years in prison

Seven defendants in a fatal explosion case at PT ASL Shipyard Indonesia, which resulted in the deaths of 14 workers, have been handed lenient prison sentences by the prosecutor's office, ranging from one to two years.

The charges stem from an explosion on the MT Federal II tanker at the Tanjung Uncang shipyard in Batam, Kepulauan Riau. The Public Prosecutor's Office, represented by Muhammad Arfian, presented the sentences during a hearing at the Batam District Court.

Among the defendants are foreign nationals, including Kim Dong Gyun, the Commercial Manager from South Korea, who was sentenced to 1 year and 6 months. Other foreign nationals, Neo Ah Chye (Singapore), Abdullah bin Ismail (Malaysia), and Dranreb Ray Adino Dimayacyac (Philippines), received sentences of 2 years and 6 months for their roles as Assistant Production Manager, Ship Manager, and supervisor, respectively.

Three Indonesian citizens, Mijrebel Siregar (HSE Officer), Rikardo Parlindungan Barasa (HSE Promotor), and Basar Samuel Sialagan (HSE Promotor), also received 2 year and 6 month sentences. The prosecutor stated that all seven defendants were proven to have participated in negligence that led to the deaths of others.

While the prosecution noted aggravating factors, such as the 14 fatalities, 9 severe injuries, and 7 minor injuries, it also considered mitigating circumstances. These included the defendants having no prior criminal records, their respectful conduct during the trial, their admission of guilt, and remorse. Crucially, the victims' families have forgiven the defendants, and settlements have been reached with all heirs. The defendants also covered medical expenses, provided compensation to the families of the deceased, and bore other associated costs.

With this, the court imposes a sentence of imprisonment for 1 year and 6 months on the defendant Kim Dong Gyun alias Kim, minus the period of detention already served, and the defendant shall remain in detention.
