Dominican judge withdraws from performance evaluation

Supreme Court Justice María Garabito Ramírez has informed President Luis Abinader, in his capacity as head of the National Council of the Magistracy (CNM), of her decision to withdraw from the performance evaluation for high court judges. This makes her the third magistrate to opt out of the process, which is a constitutional requirement to assess if judges completing seven-year terms will continue their service.

In her letter, Justice Garabito cited "deep reflection" after more than 38 years in the justice system, including roles in the Public Ministry, lower courts, appellate courts, and the Supreme Court since 2019. She stated that, according to regulations, she will remain in her position until the CNM appoints and swears in her successor. She also expressed gratitude for the confidence placed in her appointment seven years ago.

Garabito joins Nancy Salcedo Fernández and the current Supreme Court President, Luis Henry Molina, who had previously announced their withdrawal from the evaluation. Their decisions pave the way for the CNM to select new members for the court. The CNM, chaired by President Abinader, has established regulations outlining the criteria and procedures for these evaluations, and will now proceed with assessing the remaining magistrates who wish to continue on the Supreme Court.
