Haymana court orders sale of property to dissolve inheritance partnership

The Haymana Civil Court of Peace has ordered the dissolution of a partnership through public auction, concerning immovable property located in the Medrese neighborhood of Haymana district, Ankara province. The ruling, stemming from a lawsuit regarding inheritance, mandates the sale of the property, identified by former plot numbers 13 block, 5 plot, and current numbers 850 block, 9 plot.

The court accepted the lawsuit, decreeing that the sharecropping arrangement on the specified property will be terminated by sale. This process will adhere to the regulations outlined in the Enforcement and Bankruptcy Law. All partnership liabilities and obligations will be included in the sale.

Following the auction, the sale price will be distributed among the shareholders according to their respective shares as recorded in the land registry. Any encumbrances noted in the land registry will be reflected in the final sale price. A fee of 0.1138% will be levied on the sale price, with the advance fee deducted and the remainder divided proportionally among the parties and recorded as treasury revenue.

Litigation expenses totaling 12,163.05 Turkish Lira, incurred by the claimant, are to be paid proportionally based on title deed shares. The respondents will cover their portion, and the claimant's portion will be retained. The court also ordered the refund of any remaining advance expense payments to the claimant. Additionally, a fixed attorney fee of 18,000.00 Turkish Lira, calculated based on the minimum fee tariff, is to be collected from the respondents and paid to the claimant's attorney. The decision was communicated to the claimant's attorney and one of the respondents in person.
