"Ibar-Lepenac" Denies Demolishing Jezero Hotel Before Court; Site Visit Scheduled

The public enterprise "Ibar-Lepenac" has denied responsibility for the demolition of the "Jezero" hotel on Gazivoda Lake, which was removed by heavy machinery on July 30. Appearing before the Basic Court in Mitrovica, the company's representative stated that "Ibar-Lepenac" did not carry out the demolition, but instead sought to "liberate" property they claim as their own.

Conversely, the lawyer representing Jordan Jakšić, the hotel owner, asserted that "Ibar-Lepenac" destroyed the property without any legal grounds, causing an estimated two million euros in damages. Jakšić's legal team had previously requested a temporary court measure to prevent the demolition, arguing that such action was illegal and that their client had not been presented with any executive decision authorizing the destruction of his property.

The defendant Ibar Lepenac, in the meantime, without any legal basis and contrary to all legal provisions governing property rights, on 07/30/2026, with the assistance of the Kosovo Police, demolished the 'Jezero' facility, which is the subject of this dispute.

The court is now seeking answers. A visit to the site of the demolished hotel is scheduled for tomorrow, accompanied by a geodetic expert. Additionally, the court will request information from the Kosovo Police and the relevant ministry to determine who ordered the demolition and on what basis it was carried out. The hearing took place nearly two weeks after the hotel was already destroyed, a fact highlighted by Jakšić's lawyer, who argued that the damage would have been prevented if the court had issued a measure earlier.

If this measure had been adopted on 07/25/2026, the defendant would not have caused such great damage, which is now irreparable for the plaintiff, i.e., the proposer of the measure.
