Indonesian Ulema Council Seeks Transparency in Palestinian National's Arrest

The Indonesian Ulema Council (MUI) is calling for government transparency following reports of a Palestinian national's arrest by Indonesian law enforcement. Prof. Sudarnoto Abdul Hakim, head of MUI's Foreign Relations and International Cooperation, stated that while respecting law enforcement's authority, the principles of due process, human rights, transparency, and accountability must be upheld.

On principle, on behalf of the Indonesian Ulema Council, I respect the authority of Indonesian law enforcement officers in carrying out their duties in accordance with the constitution, laws and regulations, and Indonesia's international commitments. However, in every law enforcement process, the principles of due process of law, respect for human rights, transparency, accountability, and justice must remain the main foundation.

Sudarnoto noted that information is limited but the news is surprising and raises many questions. He urged the government to ensure that if legal proceedings are underway, they are conducted openly and in accordance with applicable laws. He also stressed the importance of providing legal aid and adequate legal protection for the individual concerned.

"I truly hope the government pays serious attention to the humanitarian and international political dimensions of this case," Sudarnoto said. He reiterated Indonesia's constitutional mandate to support Palestinian independence, as stated in the preamble of the 1945 Constitution, which calls for the abolition of colonialism. This commitment, he argued, should guide policies concerning Palestinian nationals.

Furthermore, Sudarnoto advised the government to ensure that any potential transfer of the individual to another country does not endanger their safety, basic rights, or human dignity. He stressed that Indonesia should not participate in any process that could lead to the person being handed over to parties posing a threat to their safety, freedom, or human rights, emphasizing the principles of humanitarian protection, non-refoulement, and respect for international law.

Indonesia since its inception has placed support for Palestinian independence as an inseparable part of the mandate of the Preamble of the 1945 Constitution of the Republic of Indonesia, which states that colonialism in the world must be abolished because it is not in accordance with humanity and justice.
