Kyrgyzstan Considers Simplified Extradition Process

Kyrgyzstan is exploring the introduction of a simplified extradition process to enhance its international cooperation in criminal matters. The proposed amendments to the Criminal Procedure Code are currently open for public discussion.

The Prosecutor General's Office stated that in an era of globalization and rising transnational crime, efficient international cooperation is crucial. Current extradition procedures are often lengthy and multi-stage, leading to reduced effectiveness in criminal prosecution, increased burdens on law enforcement and judicial bodies, and higher state expenditures. The new institute of "simplified extradition" is intended to optimize these processes.

This initiative is also driven by recommendations from the Financial Action Task Force (FATF), which sets global standards for combating money laundering and terrorism financing. Kyrgyzstan's 2018 mutual evaluation criteria necessitate the provision for simplified extradition. The reform is designed to apply exclusively when an individual voluntarily consents to extradition and no legal obstacles exist.

Furthermore, the draft law proposes extending the period of extradition arrest from two to six months. Officials argue this extension is necessary because the current two-month period is often insufficient to complete all procedures related to extradition requests. This change aims to align national legislation with the realities of international cooperation, improve the enforcement of obligations to extradite criminals, and reduce the risk of wanted individuals being released on formal grounds.
