Kyrgyzstan: Plea deals and mental health to allow case separation

President Sadyr Japarov of Kyrgyzstan has signed amendments into law that will alter the country's Criminal Procedure Code. These modifications empower investigators and courts to segregate criminal cases under specific circumstances.

Under the new provisions, a criminal case can be split into a separate proceeding if one or more accused individuals enter into a plea agreement, admitting guilt. This also applies if it is determined that an accused person committed the act while in a state of insanity or developed a mental disorder after the crime. Such separation is permissible provided it does not compromise the completeness or objectivity of the investigation.

Further grounds for separating cases include the large volume of evidence or a multitude of episodes within a single case. Additionally, if during an investigation or trial, information emerges about another crime committed by a different individual, unrelated to the main accusation, the relevant materials will be separated for a new proceeding. Investigators are required to promptly record this information in the Unified Register of Crimes.

The amendments also introduce a provision allowing other affected individuals to appeal court decisions, specifically those that impact their property rights. This change aims to provide a clearer legal recourse for parties whose assets may be affected by judicial rulings in criminal proceedings.
