Lula's Panama hat photo not electoral propaganda, says prosecutor

The Brazilian Superior Electoral Court (TSE) is considering whether President Lula's choice of a Panama hat in his official voting machine photograph constitutes electoral propaganda. The Electoral Public Ministry, represented by Deputy Prosecutor General Alexandre Espinosa, has advised the TSE that the accessory does not carry electoral connotations and does not impede voter recognition.

Lula, who is seeking his seventh presidential term, is seen in the photograph wearing the hat. According to his press office, he began wearing it on medical advice after a skin cancer lesion was removed from his scalp in April. The Panama hat, historically associated with the construction of the Panama Canal in the 20th century, was often worn for sun protection.

Espinosa argued that allowing the hat in the photograph best serves political pluralism, a cornerstone of Brazil's democratic state. The TSE's regulations for voting machine photos require a frontal, bust shot with "appropriate attire for an official photograph." The rules also prohibit "scenic elements and other adornments, especially those with electoral propaganda connotations or that hinder candidate recognition."
