Poland adopts simplified short-term rental bill, omits 'no-rental zones'

Poland's government has moved forward with a bill to regulate short-term rentals, adopting a streamlined version that aligns with EU Regulation 2024/1028 concerning data collection for such services. The original deadline for this EU regulation was May 20, requiring member states to have a functioning registry. However, Poland's delayed progress and disagreements over provisions beyond the EU's scope led the Ministry of Sport and Tourism to prioritize uncontroversial elements.

The most significant point of contention is the removal of a clause that would have granted local governments the authority to designate "no-rental zones" for short-term accommodations. This decision has sparked outrage and concern among various municipal associations.

The Union of Polish Metropolises (Unia Metropolii Polskich) expressed approval for the central registry and the implementation of EU requirements, noting it will help understand the scale of the short-term rental market and bring offers under administrative control. However, they voiced significant concern over the government's decision to exclude provisions empowering local governments to tailor short-term rental regulations to local conditions and challenges. They argue that cities and municipalities should have the power to decide on these matters, including local taxes and fees associated with short-term rental businesses.

Grzegorz Kubalski, deputy director of the Association of Polish Powiats (Związek Powiatów Polskich), echoed these sentiments. He described the idea of allowing municipalities to create "no-rental zones" as a well-thought-out tool to counteract the uncontrolled spread of short-term rentals in tourist hotspots, which negatively impacts neighbors and the social fabric. Kubalski believes the government's decision reflects an unwillingness to confront the powerful short-term rental industry, prioritizing economic interests over local community needs. He views the government's promise to revisit the issue later as an empty one, questioning the likelihood of legislative changes after the bill's passage.
