Turkish Bar Association Condemns Actions Against Lawyers Representing Detained Mayor

The Union of Turkish Bar Associations (TBB) has strongly condemned recent searches and seizures conducted at the offices, residences, and vehicles of lawyers Umut Yaşar and Ezgi Tezcan Yaşar, who are representing the detained Kuşadası Mayor Ömer Günel.

In a written statement, the TBB asserted that these actions, carried out under a gag order in an investigation by the Istanbul Chief Public Prosecutor's Office, deepen violations of fair trial rights. The association highlighted alleged procedural irregularities during the searches, particularly concerning the confiscation of files related to Mayor Günel. It was reported that the number of confiscated files, their corresponding investigation and prosecution numbers, and their contents were not properly documented.

Furthermore, the TBB noted that the procedures for searching computers, software, and databases were not followed, and copies of the search, seizure, and sealing records were not provided to the lawyers. The Aydın Bar Association reportedly stated that no official request was made to the Bar Presidency to ensure adherence to legal procedures requiring their presence during searches of law offices.

The TBB expressed concern that these apparent violations of procedure create an impression of hostility towards the legal profession. Such actions, they argued, infringe upon the right to a fair trial and the right to defense, which are fundamental components of legal security for individuals. The association urged an immediate halt to these unlawful practices and called for the legal security and guarantees of the lawyers and their clients to be ensured, emphasizing that the TBB will continue to closely monitor the situation.
