The order, signed on August 6, 2026, frames U.S. citizenship as a valuable inheritance being exploited through calculated evasion of immigration laws.

The White House stated that the measure is designed to close loopholes that allow foreign nationals to use non-immigrant visas to secure citizenship for children born in the U.S. The Secretaries of State and Homeland Security are empowered to implement this new policy. They are directed to prevent the entry of individuals attempting birth tourism, revoke existing visas and travel authorizations, and permanently bar those found to have engaged in the practice.

The order emphasizes the U.S. government's interest in ensuring that each visa category is used strictly for its intended purpose.
